Former Supreme Court judge Madan Lokur express his concern that the provision of grant leave to appeal is not being applied before applying for relief in the matter at Supreme Court while responding to the measures on reducing the number of SLP in the apex Court.
Former Rajasthan High Court judge Raghavendra Chauhan "The constitution has itself laid down the procedure for coming to Supreme Court, you have to issue a certificate from the respective High Court to apply for a special leave application while proving that your case involves a critical constitutional issue. It is the court that will decide whether the certificate should be granted or not. As far as I know the procedure for granting certificate to appeal has not been followed in many years. This provision of the constitution has been rendered a dead letter. "
Responding to the delays in cases which appears to be of national importance and pose question about judicial system, former Chief Justice of Orissa High Court Justice S. Muralidhar says "big tribute to the Indian judiciary, especially at the level of magistrates, district judges etc, who contribute to deciding 10 million cases every year. The UAPA Act and it's amendments have a tremendous impact on the judiciary. People are unable to get bail, and they have to repeatedly travel from the trail Court to the High Court and back to trail Court. Even when they don't get relief, they go to supreme Court, like in the case of Father Stan Sway who had to go to the apex Court for the permission to get straw"
